Common Questions About Personal Injury Law

Is it worth hiring a personal injury attorney?

Yes, if you are injured in an accident that was not your fault, a personal injury attorney can help you recover damages for your losses.  These accidents include car accidents, truck accidents, pedestrian accidents, slip and falls, trip and falls and other accidents that result in bodily harm.  Your losses can be medical expenses, lost income, or other out of pocket expenses.  You may also be entitled to damages for pain and suffering.

When to get an attorney for a car accident?

You should consult with an attorney if you are injured in a car accident ( or any accident).  An attorney can explain your rights to you, help you understand how automobile insurance works and what damages you may be entitled to.  Some cases can be settled before going to court, but many do not. An attorney can help you maximize your recovery.   You should always have an attorney if your case goes to court.

How to find a personal injury lawyer?

A personal injury attorney helps you understand your rights and represents you if you make a claim.  As a general rule, the location where the accident took place is where any lawsuit would be filed.  Finding an attorney with a local presence is important. Aside from typical online search options, you can also contact the local bar association.

What to do after a car accident?

After calling the police, you should contact your insurance company and report the accident.  Your insurance company will take your information and explain what is covered by your insurance. f you are injured or think you may be injured, seek medical help as soon as possible.   The insurance company may send an adjuster to review the damage to your car and assign another claims representative to follow up with your injuries.  You should contact your attorney to make sure your rights are secured and you obtain the best advice to make sure you are properly compensated for your damages.  If you can, take pictures of the accident scene and your injuries.  Keep notes on what happened and what you are experiencing.  This can be helpful if facts about the accident become an issue later.

Can someone sue you for a car accident if you have insurance?

If you are involved in an accident and it is your fault, your insurance is responsible for the damages.  You are the named party in a lawsuit but your insurance should cover an attorney to represent you and defend the suit.

Who pays for car damage in a no-fault state?

You are responsible for damage to your car.  Initially, your insurance will cover the damage (depending on whether you purchased collision or comprehensive coverage).  If the accident is not your fault, your deductible will even be reimbursed to you.
